These Terms of Use govern access to and use of kmwconstruction.com and its public content and features. They do not replace a signed construction contract, proposal, employment agreement, or other written agreement with Keith M. Webster Construction, LLC or Keith M. Webster Construction, Inc.
Important distinction. Website descriptions, photographs, schedules, budgets, project examples, and communications are general information—not a bid, warranty, design document, or promise to perform work. A project begins only through an authorized written agreement. If a signed agreement conflicts with these website terms, the signed agreement controls for that relationship.
1. Acceptance
By accessing or using this website, you agree to these Terms of Use and acknowledge our Privacy Policy. If you do not agree, do not use the website.
2. Website purpose
The website presents general information about Keith M. Webster Construction, LLC and Keith M. Webster Construction, Inc. (collectively, "KMW," "we," "us," or "our"), selected work, our approach, career opportunities, contact details, and links or interfaces for third-party services. We may change, suspend, or discontinue any public content or feature at any time.
Website content is general information and is not project-specific architectural, engineering, legal, financial, safety, or code-compliance advice. Obtain advice from appropriately licensed professionals familiar with your project and circumstances.
3. Construction services and written agreements
Nothing on this website obligates KMW to accept, bid, schedule, supervise, or perform a project. An inquiry, consultation, site visit, exchange of information, preliminary budget, or other discussion does not create a contractor-client relationship or duty to perform work.
Construction work is governed by a separate written agreement signed by authorized representatives. That agreement may address scope, price, allowances, exclusions, schedule, payment, insurance, changes, warranties, dispute procedures, and other project-specific terms. It controls over this website for the project it covers.
Licensing and authorization to perform work vary by trade and jurisdiction. License numbers displayed on the site are informational and should not be interpreted as a representation that KMW is authorized for every kind of work in every location. Prospective clients may verify current license status with the relevant licensing authority.
4. Estimates, schedules, plans, and project information
Any website statement or preliminary communication concerning cost, schedule, availability, materials, methods, constructability, or outcome is illustrative and nonbinding unless included in an authorized written agreement. Actual conditions may be affected by design changes, site conditions, weather, labor and material availability, permitting, inspections, utilities, code requirements, and other project-specific factors.
Concepts, sketches, renderings, photographs, plans, samples, and digital images may not show final dimensions, color, texture, detailing, performance, or site conditions. Plans and specifications must be reviewed and approved through the applicable project process. Do not use website material to build, modify, price, or permit a project.
5. Portfolio, photographs, and testimonials
Project pages and photographs show selected work and may reflect collaboration among owners, architects, designers, engineers, craftspeople, subcontractors, vendors, photographers, and others. Inclusion does not claim sole authorship of every depicted element. Project details may have changed after photography.
Testimonials reflect the individual experience and opinion of the person quoted. They are not a guarantee that another project will have the same scope, schedule, cost, process, or result.
6. Inquiries and other submissions
You are responsible for information you send through the site, by email, or by telephone. Do not provide information or materials that are unlawful or that violate another person's privacy, confidentiality, intellectual-property, or other rights.
You retain ownership of materials you submit. You grant KMW a limited, nonexclusive permission to receive, copy, store, review, and share them with our personnel and service providers as reasonably necessary to respond, evaluate an inquiry or application, protect our systems, and comply with law. This permission does not authorize KMW to publish your résumé or private project materials for advertising.
Do not send confidential plans, trade secrets, privileged information, sensitive personal data, or proprietary concepts before KMW agrees in writing to receive them on a confidential basis. Sending unsolicited information does not create a confidentiality, fiduciary, design, employment, or contractor-client relationship.
7. Careers and job applications
The careers page may list roles that are commonly needed, but a listing does not mean a position is currently open. Submission of an application does not guarantee review, an interview, an offer, or employment. KMW may close, suspend, revise, or fill a recruiting opportunity at any time, subject to applicable law.
Applicants must provide truthful and complete information. Do not include Social Security numbers, driver's-license or passport numbers, bank information, medical information, immigration documents, or other highly sensitive information in the public careers form unless specifically requested through a secure process. Any employment offer, if made, is governed by its own written terms and lawful screening or verification requirements.
KMW is committed to lawful equal-employment practices. Nothing in these terms limits rights or obligations under applicable employment law.
8. Client Login and third-party services
The Client Login page embeds a login interface provided by Buildertrend. Social-media pages, Houzz, fonts, security tools, advertising services, and other external resources may also be provided by third parties. Their services are governed by their own terms and privacy policies, and they may change or become unavailable without our control.
You are responsible for safeguarding credentials to any client portal and for activity under your account. Do not share credentials with unauthorized people. Notify your KMW project contact and the platform provider promptly if you suspect unauthorized access. KMW is not responsible for an unaffiliated provider's independent acts, omissions, availability, content, or security, except where applicable law does not allow that limitation.
9. Acceptable use
You may use the website only for lawful, personal, and legitimate business purposes. You may not:
- violate law or another person's rights;
- submit false, misleading, fraudulent, defamatory, infringing, unlawful, or malicious material;
- upload malware, harmful code, or files designed to disrupt, damage, monitor, or gain unauthorized access;
- probe, scan, test, bypass, disable, or interfere with security, authentication, access controls, rate limits, forms, or network operation;
- impersonate another person, misrepresent affiliation, harvest personal information, or use the site for spam or unsolicited marketing;
- use automated means to scrape, copy, index, download, or extract site content except ordinary search-engine crawling that respects published directives;
- frame, mirror, republish, sell, sublicense, or commercially exploit the site or its content without written permission; or
- assist anyone in doing any of the above.
We may block or restrict access and preserve or disclose relevant information when reasonably necessary to protect the website, users, KMW, or others, or to comply with law.
10. Intellectual property
The website and its text, photographs, graphics, logos, project presentations, layout, selection, compilation, code, and other content are owned by or licensed to KMW and protected by copyright, trademark, and other laws. Third-party names and marks belong to their respective owners.
You may view the public website for personal, noncommercial evaluation of KMW and its services. You may not reproduce, distribute, modify, publicly display, or commercially use site content without prior written permission from the applicable rights holder.
11. Privacy and electronic communications
Our Privacy Policy separately explains our website data practices. It is provided as a privacy notice and does not create contractual rights or obligations beyond those required by applicable law. Internet, telephone, and email communications are not guaranteed to be secure or error-free. If you send an inquiry, application, or other request, we may use the contact information you provide to respond and administer that relationship, subject to applicable law and the Privacy Policy.
12. Disclaimers
To the fullest extent permitted by law, the public website and its content are provided "as is" and "as available." KMW disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, security, and freedom from harmful code.
We do not warrant that the site will always be available, current, accurate, uninterrupted, or error-free; that defects will be corrected; or that site content will be suitable for a particular property, project, bid, application, or decision. Some jurisdictions do not permit certain warranty exclusions, so part of this section may not apply to you.
This website is not an emergency or jobsite-safety reporting channel. For an emergency, call 911 or the appropriate local authority. For an active KMW project, use the emergency, safety, and communication procedures established for that project.
13. Limitation of liability
To the fullest extent permitted by law, KMW and its owners, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, goodwill, or opportunities, arising from or related to the public website, its content, or an unaffiliated third-party service.
These limits apply only to the extent permitted by law and do not apply to liability that cannot lawfully be limited or excluded. They do not alter liability allocated by a separate signed construction, employment, or other agreement.
14. Governing law and disputes
These website terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules, except to the extent nonwaivable law requires otherwise. Subject to such nonwaivable law, a dispute concerning only these website terms or public-site use must be brought in a state or federal court with jurisdiction in or serving Pitkin County, Colorado, and each party consents to that venue and jurisdiction.
A construction contract, employment agreement, portal agreement, or other signed agreement may contain different governing-law, venue, mediation, arbitration, claim-notice, or dispute provisions. Those provisions control disputes within their scope.
15. Changes and general terms
Changes
We may update these terms by posting a revised version and changing the effective date. Changes apply prospectively unless law requires another form of notice.
Severability and waiver
If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.
A separate signed agreement governing construction, employment, a client portal, or another relationship controls matters within its scope. The Privacy Policy applies separately to our handling of personal information.
